Terms of Service

This Terms of Service agreement ("Agreement") outlines the terms and conditions under which you ("User", "you", or "your") may access and use the Tobiah mobile application and related services (collectively, the "App") provided by Tobiah ("we", "us", or "our"). By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agreed to be bound by the terms outlined below. If you do not agree to these terms, you may not use the App.

Use of the Service

The Tobiah App is intended to provide educational content and tools for health, nutrition, and lifestyle tracking. This includes, but is not limited to, features such as meal logging, recipe suggestions, sleep tracking, barcode scanning, AI-powered product analysis, and insights into hormone health. All content is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied.

Eligibility and Account Responsibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You agree to provide accurate, current, and complete information, and to comply with all applicable local, state, national, and international laws in your use of the App.

Acceptable Use

You agree to use the App only for lawful and intended purposes. You may not use the App in any way that infringes upon the rights of others, violates applicable laws or regulations, or interferes with the normal operation, security, or integrity of the service. This includes, but is not limited to, transmitting malicious code, gaining unauthorized access to data, using the App for commercial purposes without our consent, or uploading content that is illegal, obscene, or otherwise inappropriate.

Health and Medical Disclaimer

All content and features within the App are provided for informational and educational purposes only and are not intended to be a substitute for professional medical advice, diagnosis, or treatment. The App does not establish a doctor-patient relationship. You should always seek the advice of a qualified healthcare provider regarding any medical concerns. If you are experiencing a medical emergency, call emergency services immediately. We make no claims about the applicability or accuracy of health-related content to your specific situation.

AI and Machine Learning Limitations

The App uses artificial intelligence and machine learning technologies to analyze ingredients, suggest products, and generate insights. These AI-generated results are for educational purposes only and should not be relied upon as medical or nutritional advice. We do not guarantee the accuracy, completeness, or relevance of any AI-powered content. Use of these features is at your own risk, and you acknowledge that third-party AI services may be subject to their own terms and limitations.

Camera and Image Permissions

Some features of the App require access to your device’s camera to enable barcode scanning and image-based product analysis. By using these features, you grant us permission to access your camera and process submitted photos. Images may be temporarily stored for analysis purposes. While we implement reasonable security measures, we cannot guarantee complete privacy or security of uploaded content.

Third-Party Services and Data Sources

Tobiah integrates with various third-party platforms and data providers including, but not limited to, Firebase, Google Vision API, OpenFoodFacts, PubMed, NIH ODS DSLD, ChEMBL, OpenFDA, WHO, and the CDC. Use of these services is subject to their own terms of service and privacy practices. We do not control or guarantee the availability, accuracy, or reliability of data from these sources, and we are not liable for any issues arising from third-party services or outages.

Data Accuracy and Content Reliability

The App provides product information, ingredient analysis, and health insights gathered from public and third-party sources. We do not warrant the accuracy, completeness, or usefulness of any data presented. Nutritional content may vary by product, and AI-generated ingredient analysis may be incomplete or incorrect. You are solely responsible for verifying important health or nutrition-related decisions with reliable sources or professionals.

Intellectual Property

All content, design, software, logos, trademarks, and other intellectual property within the App are the exclusive property of Tobiah or its licensors. You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the App without prior written permission from us.

Privacy

Your privacy is important to us. Please refer to our Privacy Policy to understand how we collect, use, and share personal information. By using the App, you acknowledge and agree to the practices outlined in the Privacy Policy. We are not responsible for the data-handling practices of third-party services.

Limitation of Liability

To the fullest extent permitted by applicable law, Tobiah, its developers, owners, and affiliates shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising out of or related to your use of the App. This includes, without limitation, damages resulting from personal injury, property loss, data corruption, medical complications, financial loss, emotional distress, third-party actions, security breaches, or reliance on AI-generated content. If liability cannot be excluded, our total aggregate liability shall not exceed $1.00 USD. You agree to indemnify and hold harmless Tobiah from any claims, demands, or damages arising from your use of the App.

Disclaimer of Warranties

The App and all related services are provided “as is” and without warranties of any kind, whether express or implied. We expressly disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and security. We do not guarantee uninterrupted or error-free access to the App, and we are not responsible for third-party content, services, or data.

Force Majeure

Tobiah is not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, strikes, cyberattacks, or failures of third-party systems.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States. Any disputes arising out of or in connection with these terms shall be resolved exclusively in the state or federal courts located in Delaware.

Severability

If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from the remaining terms and shall not affect their validity and enforceability.

Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, and without liability. You may terminate this Agreement by discontinuing use of the App.

Changes to These Terms

We may update or revise these Terms of Service at any time. We will take reasonable steps to notify users of material changes, but it is your responsibility to review the current terms. Continued use of the App after changes are posted constitutes your acceptance of the revised terms.

Entire Agreement

These Terms of Service, together with our Privacy Policy, represent the complete agreement between you and Tobiah regarding your use of the App. No other prior agreements or representations shall be binding unless made in writing and signed by us.

By using the Tobiah App, you acknowledge that you have read, understood, and agreed to these Terms of Service in full, including all disclaimers and limitations of liability.
